The federal judge found unlawful an Equal Employment Opportunity Commission regulation that permitted the EEOC to issue a Notice of Right to Sue to the plaintiff before 180 days had passed after the plaintiff’s filing of the required charge of discrimination. Consequently, the plaintiff’s suit was premature.
