Teresa D. Teare and Paul D. Burgin won a motion to dismiss a federal lawsuit on behalf of a large health care employer. The court found that the Complaint was untimely as it was not filed within 90 days after the plaintiff’s receipt of her right to sue letter from the EEOC. Although the plaintiff alleged that it was her attorney’s negligence that lead to the late filing, the court did not find her circumstances justified tolling of the statute of limitations.
