Chad M. Horton won a victory in a contract interpretation case for a company that operates in the distilled spirits industry. The arbitrator held that the company did not violate the parties’ collective bargaining agreement when it implemented a rule providing for disciplinary action where an off-duty employee was arrested for driving while intoxicated. The arbitrator agreed that the rule was reasonable and that the company met any bargaining obligation it may have had by notifying the union of the proposed implementation and meeting with the union concerning the rule, during which it conveyed its desired rollout date.
