Parker Thoeni and Evan Conder Partial Motion to Dismiss

Parker E. Thoeni and Evan Conder won a partial motion to dismiss in federal court on behalf of a senior living facility. The court agreed that the employee had failed to file the required charge of discrimination with the Equal Employment Opportunity Commission as to her claims of discrimination on the basis of her genetic information and disability, as well as her retaliation claim. Although she had filed a charge alleging failure to provide a religious accommodation, her other claims were not sufficiently related to that claim to meet the charge prerequisite.
