Eric Hemmendinger Won a Motion to Dismiss

Eric Hemmendinger won a motion to dismiss for a heating and cooling contractor on an employee’s claims under the D.C. Wage Payment and Collection Law that he was not paid the prevailing wage as required under the Davis-Bacon Act. The D.C. Superior Court agreed that the Act does not give rise to a private cause of action against an employer, and that the plaintiff cannot use the D.C. WPCL to make an “end run around the Davis-Bacon Act.”
