Parker Thoeni and Paul Burgin won a motion to dismiss in federal court on behalf of a skilled nursing facility. The plaintiffs had alleged that the client was liable as a successor entity for its predecessor’s alleged delinquent employee fringe benefit contributions. The court agreed that Plaintiffs did not allege sufficient facts to establish that the client was on notice of the liability prior to its purchase of its predecessor’s assets.
