The union alleged that the company had violated the collective bargaining agreement when it began pro-rating the annual incentive payment for employees who were not actively at work. The arbitrator found that the company’s management rights clause had “extraordinarily strong prohibitions regarding the use of past practices,” and the company was entitled to determine eligibility for the payment.
