Darryl McCallum Won a Motion To Dismiss In Wrongful Termination Suit

Darryl G. McCallum won a motion to dismiss the Plaintiff’s complaint in federal district court for a transportation company. The Plaintiff, a union member, had sued for wrongful termination after rejecting a settlement of his grievance under the grievance and arbitration procedure in the collective bargaining agreement.  The court, however, found that the grievance and arbitration procedure was the binding and exclusive remedy for resolving employment disputes.
