Firm Partner Stephen Shawe Wins Arbitration

On behalf of an energy company, Stephen Shawe won an arbitration. The union had claimed that the employer did not have the authority under the collective bargaining agreement to change the benefit structure of the health insurance plan by increasing co-pays and deductibles. The arbitrator, however, concluded that the description of the benefit level contained in the CBA applied to only the first year of the agreement and that the employer had retained the ability to modify the benefits over the remaining years of the CBA.
