SR Labor and Employment Law Conference – October 26-27, 2017
Shawe Rosenthal LLP invites you to attend our client conference at the beautiful Loews Annapolis Hotel, and to join us in celebrating our 70th anniversary. Our sessions will cover a variety of labor and employment issues relevant to your workplace, including:
- State Law Trends and Update. Paid sick leave, in one form or another, will be coming to Maryland in the near future, and we will preview what a future law will likely look like. We will also review recent court decisions on the intersection of state medical marijuana and disability laws. Additionally, we will identify legislative trends in other states that you can expect to see coming to our area and review recently enacted employment legislation from Maryland and surrounding jurisdictions.
- Workplace Violence Best Practices for Prevention and Response. Promoting a work environment free from threats and violence is the duty of every employer. This presentation will help educate you about the forms that workplace violence can take, as well as warning signs and the most effective ways of reducing or eliminating workplace violence hazards.
- The New Trump NLRB: Is There Hope for a Light At the End of This Long Dark Tunnel? The Obama Board greatly expanded a number of union and employee protections under the National Labor Relations Act. In light of the change in administration, we will review the status of labor law issues applicable to both union and non-union employers including: employee conduct, work rules, joint employer issues, protected concerted activity, political strikes (“A Day Without a ….”), and union avoidance.
- The Potential Risks and Rewards of Cutting Edge Tech in the Workplace. Savvy employers are harnessing new technology to improve efficiency and productivity, and federal agencies are taking an interest in how the resulting “people analytic data” is used in employment decision making. In addition, employers must think about employee use of wearable technology, such as smart watches or fitness trackers. And, with the introduction of augmented/virtual reality into the mainstream, this technology will inevitably find its way into the workplace. We will review these developments and discuss the potential risks and rewards of using new technology in the workplace.
- What’s in a Name? Misclassification Issues and How to Avoid Them. Your labor force may be made up of employees, subcontractors, independent contractors, and/or consultants. But, what do those titles really mean and are they, in fact, appropriate classifications under the myriad of laws that govern the employment relationship? We will explore the employment status tests that courts and government agencies, including the IRS, EEOC, DOL, and DLLR apply. We will provide tips for minimizing the risk that your contingent workforce will be deemed “employees.”
- The “Who, What, When, Where, Why and How” of Leave under the ADA and FMLA. The Americans with Disabilities Act requires employers to consider providing leave as a “reasonable accommodation” absent an undue hardship on the employer. The Family and Medical Leave Act, by contrast, is all about leave without regard to hardship. This session will provide guidance on leave issues under these two laws: who is eligible for leave, what obligations employers and employees have under each law, when the duty to provide leave is triggered, where the typical “legal landmines” are, why leave before (or in addition to) FMLA must be considered under the ADA, and how to determine when the duty to provide leave has been exhausted.
- Exploring Wage and Hour Law in 2017. We will provide an update on a multitude of recent developments at the Department of Labor including its reconsideration of overtime regulations, resumption of opinion letters, conflicting opinions on tip credit regulations, class action waivers for wage-hour cases, joint employer issues, and independent contractor issues. We will also cover state and local developments, including minimum wages and local fair scheduling laws. The session will also include a refresher concerning frequently misunderstood aspects of the white collar exemptions from overtime.

- Best Practices for LGBT Employees in the Workplace. We will discuss the latest developments relating to workplace protections for LGBT workers, as well as best practices for dealing with transitioning employees.
- Restrictive Covenants: The Key to Protecting Valuable Business Assets. We will review court decisions and new laws focusing on restrictive covenants, and discuss how to formulate and use restrictive covenants to protect your confidential information and important relationships with customers, referral sources, and employees.
- Internal Investigations: The Do’s and Don’t’s of Workplace Investigations. We will discuss the steps an employer should take in order to conduct a legally sufficient investigation. We will outline best practices that employers should follow as soon as they receive a verbal or written complaint, including who should investigate, the form the investigation should take, and when to get outside counsel involved.
We will begin with breakfast and coffee on Thursday morning, October 26, followed by presentations from 8:30 a.m. to 1:00 p.m. A reception and dinner will be held Thursday evening to celebrate our 70th anniversary. Presentations will continue Friday from 8:30 a.m. and conclude at 1:00 p.m. Ample time will be provided for you to network with other clients, and explore Annapolis. We will be arranging for golf at a nearby course. A spa is located close to the hotel.
Our conference has been approved for SHRM 7.00 (HR (General)) recertification credit hours. Shawe Rosenthal LLP is recognized by SHRM to offer Professional Development Credits (PDCs) for SHRM-CP or SHRM-SCP. In addition, HRCI credit will be submitted.
